Charge Col.Ndahura or Release Him: High Court Orders CMI,UPDF

The High Court Judge Justice Musa Ssekaana on Tuesday ordered Chieftaincy of Military Intelligence (CMI) and   Uganda Peoples Defense Forces (UPDF) to release or produce in court  Col. Atwooki Ndahura former director of crime intelligence.

This comes after his wife,one Sarah Ndahura sued the Attorney General at High Court Civil Division seeking for freedom of her husband with a habeas corpus order against the security operatives to produce her husband.

Through Col. Ndahura’s lawyer Evans Ochieng, Sarah Ndahura signed an affidavit saying that her husband should be released because he has been detained incommunicado for over two weeks and her family members have been denied access to see him since the day he was arrested by CMI operatives.

While seeking the attention of court, counsel Ochieng revealed that ever since his client was arrested from Masindi Town, none of his concerned family members has gotten a chance to meet him.

“My Lord, my client has been denied access to family members and medical care which is a violation of his rights,” he said.

Ochieng added, “He has spent more than 48 hours in detention without being arraigned in court for trial hence limiting his freedom”.

After reading Ndahura’s Wife’s affidavit and listening to counsel Ochieng’s submission, Justice Musa Ssekaana ruled that Army through Attorney General should release Col. Ndahura or with immediate effect arraign him in court because he has been detained without trial.

Col.Ndahura was arrested two weeks ago in an Army operation alongside former Inspector General of Police Gen Kale Kayihura and his juniors who are currently in detention at Makindye Military Barracks.
