Court Ruling Doesn’t Affect My Current ‘Unchallenged’ Term:Akena Vows Not To Quit Office

Kampala: The Uganda People’s Congress (UPC) President Jimmy Akena has trashed the court ruling ordering him out of the office saying that the ruling was challenging his first term which expired and therefore has nothing to do with his current term of office.

This came after court of appeal nullified the election of Akena as UPC party president and ordered the party to hold fresh elections and nominate a new president, however, Akena says this can only be implemented after the petitioners have filed a fresh case challenging his current term.

“In essence of courts ruling which upheld the order of Justice Nyanzi of 2015 for the term of office which i began in 1st July 2015 and ended by 31st June, the said term of office ended and the party held a delegates conference on 1st august where i was re-elected for another five years, now it’s up to them to go back to court to challenge this term,” Akena said.

Akena says his new leadership of the current term was through legal means after being endorsed by over 470 delegates from the regions of Ankole, Northern Uganda, West Nile, Kigezi, Teso and Sebei as the party’s Presidential flag bearer in the 2021 general elections.

However, in a Monday judgment delivered by the Court of Appeal, UPC Party was ordered to elect a new president in conformity with the provisions of Party constitution and political parties and organization Act and Constitution of Uganda.

The judgement which was delivered by a panel of three Justices including Elizabeth Musoke, Christopher Izama Madrama and Irene Mulyagonja, trashed Akena’s appeal saying that it was baseless and not weighing to leave him with the party’s top position of Presidency.

It should be remembered that the Court of Appeal judgement followed the ruling in 2015 by the High Court which declared that Akena is not the legitimate UPC president and consequently, threw him out of the office something that Akena together with the party’s electoral commission didn’t honor hence an appeal.
