‘Stop Wasting Our Valuable Time Without Evidence’-Court Warns Gov’t On Case Against Besigye

Kampala: The Buganda Road Court Grade one magistrate, Asuman Muhumuza has threatened to dismiss a case in which opposition leaders Dr Kizza Besigye and Samuel Walter Mukaaku are accused of inciting violence after the state failed to avail enough evidence to pin the two.

Muhumuza noted that the Director of Public Prosecutions (DPP)’s representative, Ivan Kyazze has defied the Court directive to avail the accused persons of all the evidence in this case so as to enable them to prepare their defence adding that had Dr Besigye been in Court, he would have dismissed the case for lack of evidence.

Besigye’s Lawyer Samuel Muyizzi informed Court that his client is away for the burial of his longtime friend Yona Kanyomozi a former MP for Kajara County in Ntungamo and National Leader in UPC.

Besigye and Mukaaku are being charged with offences stemming from their June 14th, 2022 protest against the skyrocketing prices of commodities in the country.

The two leaders staged an assembly at Kikuubo Shauriyako Parish in Kampala Central Division where they allegedly made statements indicating that it would be desirable to demonstrate which was an act calculated to cause damage and destruction of property.

It is worth noting that the two had appeared before the same court on 25th May 2022 when Besigye was granted a cash bail of UGX 30 million which he declined to pay and opted to sleep in Luzira prison for 12 days before the cash bail was reduced to UGX 3 million by the High Court.

The two have since denied the charges and the case has been adjourned to 24th October 2022.
