Gov’t ordered to compensate prisoner with 200m for breaking his Spinal Cord

High court judge in Mukono Her Lordship Justice Margret Mutonyi has tasked Ugandan government to compensate 200 millions to a prisoner who sustained permanent damages on his body after being assaulted by a Uganda prisons officer.

Henry Muloki a resident of Namatooke Village in Busamuzi sub county, Buvuma district was arrested on charges of aggravated defilement after marrying a school dropout who was only 13 years in 2012.

Muloki was remanded to Luzira prisons but sustained a fractured back bone on Kitalya Prisons farm when he stole a maize corn and one prison warder only identified as Otim badly beat him up to unconscious state.

Justice Mutonyi has consented with the convict’s side and set him free saying he had received enough punishment after sustaining permanent damage on his body but tasked government to compensate him with 200 million shillings. Mutonyi also asked Uganda Human Rights Commission to initiate investigations into prisons and prison farms where prisoners are tormented.

Mutonyi said that no one is supposed to torture anyone including security officers saying that this act of torture is against international laws on human rights.

“Your duty is to rehabilitate inmates so that they can go back to society as changed human beings, but not to torture them”Mutonyi explained.

Court Assessor attached to Mukono High Court Mr.Sowedi Owundo condemned the act and called for government to check out residues in the system who are not working according to their professional ethics.
