Novelist Kakwenza’s Wife Drags SFC, Police Commanders To Court Over Husband’s ‘Illegal’ Detention

Kampala: Novelist Kakwenza Rukirabashaija’s wife Eva Basiima has dragged top security commanders to Civil Division of the High court over husband’s “illegal detention.”

Among those dragged to court include; Special Forces Command (SFC) Commander Brig.Gen Peter Candia, Director of Criminal Investigations Directorate (CID) Grace Akullo the, Inspector General of Police Martins Okoth Ochola and the Attorney General.

On Tuesday, Makindye Chief Magistrate’s court grade one magistrate Irene Nambatya issued an order directing the government to unconditionally release Kakwenza. This was on grounds that Kakwenza had been in detention for more than the mandatory 48 hours without being arraigned in court which violates his constitutional right to liberty and fair hearing. The state has however continued to defy that court order.

Basiima now through her lawyers of Nalukoola, Kakeeto Advocates and Solicitors, and Kiiza and Mugisha Advocates wants the High court to order the respondents to bring Kakwenza dead or alive and explain why he should not be released from custody.

According to Police, Kakwenza was arrested over his repeated social media posts in which he ‘abused’ President Museveni and the First Son, also the Commander of the Land Forces, Lt Gen Muhoozi Kainerugaba.

Earlier on, lawyer Kiiza said Kakwenza was terribly tortured and is vomiting and urinating blood.

This is the third time he is being arrested by security personnel. In all incidents, he has claimed that he was tortured. He was arrested in April and September 2020.

Rukirabashaija is the author of the popular novel ”The Greedy Barbarian”, which takes on themes of high-level corruption in a fictional country.
