The court martial seating in Makindye Division, Kampala chaired by Lt. Col. Andrew Guti on Monday adjured the ruling on the Bail application for embattled Lubaga Division NRM Chairperson and Boda Boda 2010 Association Boss Abdallah Kitatta and remanded him back to Makindye Military Barracks.
Gen. Gutti said the court had not made any ruling on whether Kitatta should be granted bail. He instead adjourned the hearing till 21st May 2018.
While in court, Kitatta through his Lawyer Shaban Sanywa decried the poor living conditions at the detention facility.
”My client says, they are put in a room where they cannot see light, there is no fresh air, they give you a bucket to urinate in from within the room, he has nowhere to pray from, his sickness is worsening” Said Sanywa.
Kitata’s request for court to make a ruling on 14th or 15th of May was declined with reason that the registry has reported busy schedule on the suggested dates.
Gen. Gutti however ordered Defense Counsel Sanywa to visit and verify the conditions at the detention facility.
Sanywa said he will visit the place to ascertain the condition of the place. “This time I am going inside the facility to look at the said conditions” he said.
On Tuesday March 27, Kitatta through his lawyers submitted a bail application citing health challenges and responsibility as the NRM Chairman Rubaga Division
Prosecution alleges that Kitatta was on January 21,2018 at Vine Hotel in Wakaliga found in possession of SMG rifle and pistols without holding a valid fire arm certificate. Kitatta now battles charges of illegal possession of fire arms and military stores.
Kitata alongside 30 others were arrested for terrorizing the community and involvement in high criminal activities. The arrests were made by the Internal Security Organization (ISO) and the Chieftaincy of Military Intelligence (CMI) in connection to the death of Francis Ekalugar, an accountant at Case Clinic who was gruesomely murdered in Kampala and body was burnt beyond recognition.
