Rubbish! The Court Order That IGG Allegedly Ignored and Arrested Mugaino!
Kampala- In a shocking turn of events that has raised eyebrows across legal and political circles, the Inspector General of Government (IGG), Hon. Beti Olive Namisango Kamya (Bonk), has Wednesday ordered for the arrest of Mr.Baker Mugaino, the Commissioner for Land Registration, despite a valid court order and binding legal opinion from the Attorney General Kiryowa Kiwanuka, barring the same.
On 28th April 2025, IGG Kamya issued an interdiction letter against Mugaino. In response, Mugaino moved to court and, on 5th May 2025, obtained an administrative court order from Hon. Justice Acellam Collins. The order explicitly restrained and prevented “further implementation of the interdiction directive by the IGG and the Permanent Secretary of Lands pending determination of the main application.”
The court order barred “the 1st and 2nd Respondents (Attorney General and IGG respectively), their agents or anyone acting on their authority” from executing the interdiction or its consequences until a court decision is reached. This meant Kamya was legally barred from taking further action against Mugaino.
In a parallel development, the Permanent Secretary of Lands, Housing, and Urban Development, on 6th May 2025, wrote to the Attorney General seeking legal guidance on how to proceed with the interdiction amidst the court’s position.
In a letter dated 16th May 2024 (received by various offices on 19th May 2025), Attorney General Kiryowa Kiwanuka offered unequivocal guidance:
“The interdiction of Mr. Baker Mugaino… is void ab initio.”
Citing Article 172(1)(a) of the 1995 Constitution of Uganda, the Attorney General clarified that only the President of the Republic of Uganda—and no one else—holds the constitutional authority to appoint, confirm, or exercise disciplinary control over heads of departments like the Commissioner for Land Registration.
“IGG has no powers to interdict a Presidential appointee. All the IGG can do is write to the President for guidance,” Kiwanuka stated.
“In light of the above Constitutional provisions… you are advised to recall the said interdiction and seek further guidance or concurrence from H.E. the President.”

This legal position was copied to the Minister of Lands, Housing and Urban Development, the Deputy Attorney General, the Solicitor General, and the Deputy Solicitor General.
However, despite both the court order and the Attorney General’s binding guidance, IGG Kamya went ahead and arrested Mugaino on Wednesday, 4th June 2025, a move now widely viewed as contempt of court and a blatant disregard of constitutional and legal procedure.
Mugaino has earlier been sued by affected parties in the Makerere land saga for failure to implement court orders on the same,but once he implemented them,this time round IGG Beti Kamya accused him of abuse of office,. corruption among others. “The man doesn’t know whom to respect now,is it Kamya or the court? Because it’s now like don’t cook it,don’t roast it but I want it ready” commented one of the parties.
Questions Now Arising:
Why did Kamya defy both court and Attorney General’s binding advice?
Is there a personal interest in the Mugaino case?
Shouldn’t the president instead institute two probes? One against Kamya and another against Mugaino for alleged wrongdoing?
Does her previous tenure as Minister of Lands cast a shadow over her current actions in this ministry? Because there’s also that history.
If IGG Kamya, who is charged with enforcing accountability and rule of law, ignores a court order and binding legal guidance, the public is left wondering—who holds her accountable?
