Fort portal: Reporting it from its genesis, in the year 2016, being in his peaceful luxurious life, tycoon Allan Bright Kagoro of popular Allan Resort, Maguru Fortportal received a proposal of a business partnership for 5-years in hotel management from a one Ngonzi Sylvia aka Lisa Sylivia Ateenyi after she had allegedly developed irreconcilable differences with her former landlord called Mr.Abas of Ryna Hotel along Fort Portal-Kasese road.
Just like any other business oriented man, Allan had to go into deep business talks with the seemingly serious Sylvia at the time hence drafting a partnership contract based on a couple of terms among them including the following.
1. The duo agreed that Sylvia was to inject in some money for renovations on her part while Allan’s contribution was to provide the facility (Allan Resort).
2.That Sylivia would then first fully recover her costs injected in the renovations through sales before they could now start sharing profits and losses in future if any.
3. They also agreed that the above could come to fulfilment through approval of such expenses by both parties through proper book-keeping and filing of all expenses receipts.
4. Meanwhile, being a duo citizen who keeps travelling to the UK and back with another family living in the UK, Allan asked for a clause in the partnership agreement that allowed him to appoint his agent or manager who would take care of his interests in his absence as per the partnership agreement, which they both signed to and this was also granted.
Tycoon Allan Depart Uganda To UK For Other Businesses
Since he is a business mogul not only in Uganda but also in the United Kingdom, in the year 2017 Allan travelled to the UK leaving behind his manager Mr.Mageno Posiano on his behalf as agreed in the partnership.
Few months after Allan’s departure, Sylvia and Mageno got some disagreements on operational methods and books of accounts where he claimed some expenses were being inflated to hike the total expenses injected in renovation works she was supposed to reclaim through sales.
Sylivia Midway Drops Partnership For Tenancy Contract:
After failing to work with Allan’s agent/manager, tenant Sylvia thought of a master plan that would ‘bring peace’ to both parties, hence suggesting to become a tenant rather than a business partner, reasoning that if allowed to run the business alone would curb conflicts and due to tycoon Allan’s mode of life “peace first before money”, he accepted.
In October 2018, the landlord/tenancy agreement was drafted by Sylvia herself and sent to Allan in UK via email for approval and signing. Indeed a 3 yr contract was signed, where Sylvia was supposed to pay 3million per month to Allan Kagoro for three years.
Just like the first contract, new terms were agreed up in this new agreement including a need to have an external auditor who would give the clear picture of how much was injected in the renovations and other expenses at the facility since they were not at per on the total expenses.
After the external auditor went through the books of accounts that were managed by Sylvia, it was discovered that;
3. Auditors found out that, instead it was Allan demanding over 111m from Sylvia as opposed to what she was claiming.
Conflicts Erupt Again Despite Numerous Agreements
On signing the new agreement, which was tenant/landlord contract, after dropping the partnership contract, Sylvia only paid 13.2m to Allan which translated to 4 and a half months with promise that she would pay the rest as she works.
TheSpy Uganda has since established that in the year 2018, after the four months expired and Allan wrote a demand note to her asking for tent as agreed, she instead wrote back informing him that she was not going to pay the balance, and infact, she was going to stay in the premises for 15months to recover her money which she had injected in during the partnership period, which she herself asked to cancel.
This left tycoon Allan scratching head hence writing to her a three month vacation notice, which she dust binned saying she was not leaving till June 2020, (that’s when her alleged 15months would expire).
After three months, Allan cordoned off his place and threw her out for continuous breach of contracts. Three weeks later, Sylvia ran to court asking it to grant her permission to re-enter premises. However, court didn’t grant her that prayer, it instead ordered for STATUS QUO to remain untill the case is heard and disposed of on its merits.
However, according to Allan, Sylvia contemplated Court order and she, later on, organized a gang of hooligans at night (2am), came with pangas, hammers and other objects, broke all the barricades, gate padlocks and forced herself back into the premises at night! “She re-instated herself, ignoring court orders,yet she is the one who took me to court,” he alleged.
When Allan’s workers, including his manager Mageno, who’s talked about above and his Askari came to the scene after hearing the noise coming out of the destruction, they were assaulted thoroughly and a Police file case was opened up against the same.
Sylvia Wakes Up, Hands Over Premises, Takes Off!
Ever since 2019, Sylvia refused to pay rent to her tenantor and refused to vacate the premises, claiming she was waiting for Court’s judgement. But on Friday, without court judgement, she came kneeling for the already disappointed and furious tycoon to sign a handover letter to vacate the premises which Allan declined saying he will do so when he is satisfied with its current status. She came back the following day and fixed a few things which were spoilt and then Allan signed, then she took to the heels.
Meanwhile,the matter is still before court to ascertain who should pay who, and today Monday it comes for hearing again.
